This Privacy Policy describes how AgeeBgee Solutions, LLC d/b/a Dad is Dead ("Dad is Dead," "we," "us," or "our") collects, uses, and shares your personal information when you use our website and services at https://dad-is-dead.com (the "Service"). By using the Service, you agree to the practices described in this Policy.

1. Information We Collect

We collect personal information only when we genuinely need it to provide the Service. Information we may collect includes:

  • Account information: your name, email address, and password (managed via Microsoft Azure authentication).
  • Profile information: phone number, date of birth, and other details you choose to add.
  • Billing information: payment card details and billing address, processed by Stripe. We do not store full card numbers.
  • Vault contents: the estate planning information you choose to store, which may include financial account details, digital credentials, medical wishes, legal documents, and personal messages.
  • Custodian information: names and email addresses of the individuals you designate as Custodians.
  • Usage data: log data, IP address, browser type, and pages visited, used to operate and improve the Service.

Minors. Our Service is not directed to individuals under 18 years of age. We do not knowingly collect personal information from persons under 18. If you believe we have inadvertently collected information from a minor, please contact us immediately.

2. How We Use Your Information

We use the information we collect to:

  • provide, operate, and maintain the Service;
  • process subscription payments and manage your billing;
  • send proof-of-life check-in notifications via email or SMS;
  • authenticate your identity when you sign in;
  • notify your designated Custodians upon verification of your death;
  • respond to your support requests; and
  • comply with legal obligations.

3. Data Retention

We retain your personal information for as long as necessary to provide the Service and comply with our legal obligations. If you terminate your account, we retain your vault data for 30 days to allow you to export it, after which it is permanently deleted. You may request deletion of your account and associated data at any time by contacting us at [email protected].

4. Data Sharing and Third-Party Service Providers

We do not sell your personal data. We do not share your personal data for advertising, marketing, or analytics purposes. To operate the Service, we share limited personal data with the following trusted third-party processors. Each processor is contractually bound to use your data only as necessary to perform services on our behalf:

  • Stripe — payment processing and subscription management. Stripe receives your billing information when you subscribe. See Stripe's Privacy Policy.
  • Postmark (ActiveCampaign) — transactional and notification email delivery. Postmark receives your email address to send check-in notifications, receipts, and account emails. See Postmark's Privacy Policy.
  • Microsoft Azure (Authentication) — identity and authentication services via Azure Active Directory for Customers. Your email address and display name are stored in Microsoft's identity platform to enable secure sign-in. See Microsoft's Privacy Statement.
  • Twilio — SMS delivery for proof-of-life check-in messages (Advanced and Complete plans only). Twilio receives your mobile phone number when you enable SMS check-ins. See Twilio's Privacy Policy.

We may also disclose your information if required to do so by law or in response to valid legal process (such as a court order or subpoena).

5. Data Security and Breach Notification

We implement commercially reasonable administrative, technical, and physical safeguards to protect your personal information from unauthorized access, disclosure, alteration, or destruction. Vault contents are stored encrypted at rest.

In the event of a security breach affecting your personal information, we will notify you as required by applicable law, including Florida's Information Protection Act, Fla. Stat. §501.171. If a breach triggers Florida statutory notification requirements, we will notify affected users and, where required, the Florida Department of Legal Affairs within the timeframes mandated by law. Notification will be sent to the email address associated with your account.

Because our Service stores sensitive personal information — including financial account details and digital credentials — we treat all security incidents as high priority. However, no electronic transmission or storage system is completely secure, and we cannot guarantee that our measures will prevent all unauthorized access.

6. Email Communications

We may send you transactional emails related to your account, subscription, proof-of-life check-ins, and Service activity. These transactional emails are necessary to operate the Service and cannot be opted out of while your account is active. If we send you marketing or promotional emails, we will include an unsubscribe link. You may opt out of marketing emails at any time by clicking "Unsubscribe" in any marketing email or by contacting us.

7. External Links

Our Service may link to external sites not operated by us. We have no control over the content or privacy practices of those sites and accept no responsibility for them.

8. Your Privacy Rights

All Users. You may request access to, correction of, or deletion of your personal information at any time by contacting us at [email protected]. We will respond to verified requests within 45 days. We may extend this period by an additional 45 days with notice where reasonably necessary.

Data Portability. You may request an export of your personal information and vault contents at any time through your account settings or by contacting us. We will provide your data in a commonly-used, machine-readable format within 30 days of a verified request.

California Residents (CCPA/CPRA). If you are a California resident, you have the following additional rights under the California Consumer Privacy Act (Cal. Civ. Code §1798.100 et seq.) and the California Privacy Rights Act:

  • the right to know what personal information we collect, use, disclose, and share;
  • the right to delete personal information we have collected about you;
  • the right to correct inaccurate personal information;
  • the right to opt out of the sale or sharing of your personal information (we do not sell or share your personal information for cross-context behavioral advertising);
  • the right to limit our use and disclosure of sensitive personal information to uses necessary to provide the Service; and
  • the right to non-discrimination for exercising your CCPA/CPRA rights.

9. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by sending an email to your registered address at least 7 days before the changes take effect. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Policy.
